This document (hereinafter referred to as the "Terms & conditions") define the rules for using the website available at https://smartdecoder.eu or https://scannyme.com or https://scanny.me or https://ai.kyde.eu (hereinafter referred to as the "Website") and the related mobile application named "SmartDecoder" or "Device Nameplate AI Reader" or "Device Nameplate Decoder" (hereinafter referred to as the "Application"). The Website and Application are collectively referred to as the "Programs".

General information

1. The owner of Programs is Epacta Systemy Informacyjne Sp. z o. o. located at ul. Gościniec 14/1 62-069 Dąbrówka, Poland, entered into the register of entrepreneurs by the District Court in Poznań, 8th Division of the National Court Register under number 0000222468, with NIP number 7811755919, REGON number 634629052, hereinafter referred to as "EPACTA".
2. The use of the basic services of Programs is free of charge but some functions, especially using third-party APIs can be paid.
3. The use and providing data in Programs is voluntary.
4. The person using Website or Appliaction is hereinafter referred to as the "User".
5. Access to some of Programs functions requires logging in to a registered User Account. A User who has an active account on Website or Application is hereinafter referred to as the "Registered User".
6. Both Website and Application are intended for persons over 16 years of age.

Offered services

1. The scope of services provided electronically in Programs (hereinafter referred to as "Services") includes:
1.1. A service that allows the User to upload a photo of a device's nameplate,
1.2. Analysis service of the uploaded photo of the nameplate using Epacta own machine learning model to detect and decode a set of defined features
The set of processing features consists of: manufacturer, type, model, number, code, serial number, IP class, production date and voltage
1.2. Analysis service (paid) of the uploaded photo of the nameplate using third-party machine learning model via API to detect and decode a set of defined features.

1.3. A service providing some information resources related to the identified device such as links to the manufacturer website, the products website, the service related website and other if possible
1.4. A service allowing the User to send a request to buy a new product, an used product, a spare parts or order the service visit if possible
1.5. A service allowing the User to search for similar products in selected websites if possible
1.6. A service of presenting the list of scanned by the User in the Application or the Website

Technical requirements

For the proper operation of Website or Application on the User's device, it is necessary to provide a n internet connection, hardware and software that meets the minimum technical requirements specified below:

1. For the Website:
Computer and software with the following minimum technical specifications:
- operating system: Windows 7, 8, 10, Mac OS X
- web browser: Google Chrome (from version 98), Mozilla Firefox (from version 97), Opera, Safari (from version 14), Edge (from version 98)
- JavaScript and Cookies support enabled
- access to the Internet with a minimum bandwidth of 512 kbps
2. For the Application:
- Apple iPhone smartphone with iOS operating system (from version 15)

Complaints

1. The User may submit any complaints regarding the Services by contacting the following e-mail address: info@epacta.com.pl.
2. Complaints will be considered within 14 days from the date of receipt of the complaint by EPACTA.
3. The User will be notified of EPACTA's decision by e-mail.

GDPR

1. The administrator of personal data is Epacta Systemy Information Sp. z o. o. located at ul. 2. Issues related to the collection, storage and processing of data are regulated by the Privacy Policy available at: https://ai.kyde.eu/privacy.

Limitation of Liabiity

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL EPACTA OR ANY OF ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SITE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF EPACTA HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. The results of the analysis of pictures provided by the Users are generated by the algorithm using the machine learning model.
The content may contain errors, inaccuracies, or biases that are not intended to cause any harm, offense, or deception.
